Article 1 – Definitions
These General Terms and Conditions of Sale (hereinafter "GTC") are offered by BAKHRI RACHID, company number: 2281603920, registered office at: 217 CARRÉ CHAYER BOISBRIAND, J7G2J6 QUÉBEC CANADA (hereinafter BELLE BEAUTÉ).
Hereinafter referred to as:
"Site": the website https://belle-beaute.com and all its pages.
"Products" or "Services": all products and services available for purchase on the Site.
"Seller": BELLE BEAUTÉ, offering its Products on the Site.
"Customer": the internet user making a purchase on the Site.
Article 2 – Application of GTC and purpose of the Site
The Seller reserves the right to modify the GTC at any time by publishing a new version on the Site. The GTC applicable to the Customer are those in force on the day of their order.
This Site offers online sales of hair styling appliances, hair accessories and hair extensions.
The purchase of a Product implies the Customer's full acceptance of these GTC. The Customer acknowledges having read and fully accepted the GTC.
Article 3 – Customer Service
Customer service is accessible by email at: contact@belle-beaute.com or via the contact form on the Site. The Customer must provide their first name, last name, the subject of their request and their order number.
For any professional enquiry (partnership, media), the Company can be reached by email at contact@belle-beaute.com.
Article 4 – Order Process
The Products offered are those listed in the catalogue published on the Site. The Customer selects the desired Products by adding them to their Cart. The sale is validly formed when the Customer has confirmed their order, accepted the GTC and completed payment.
Article 5 – Prices and Payment Methods
Unless otherwise stated, prices in the catalogue are in Euros, all taxes included (VAT). BELLE BEAUTÉ reserves the right to pass on any change in the VAT rate to Product prices. The Seller also reserves the right to modify prices at any time. However, the price listed in the catalogue on the day of the order shall be the only price applicable to the Customer.
The Customer may pay by Credit Card, Apple Pay or Paypal. BELLE BEAUTÉ will archive orders and invoices on a reliable and durable medium.
Article 6 – Deliveries
Delivery costs will be indicated to the Customer before any payment. The Site has no geographical delivery restrictions. Delivery times indicated at the time of order are for information purposes only.
For deliveries outside the European Union, the Customer declares themselves the importer and accepts that customs duties or import taxes may apply. Unless otherwise stated, the Seller undertakes to deliver within a maximum of thirty (30) days after the conclusion of the contract.
If the package is returned to the Seller by the Post Office or other postal providers, the Seller will contact the Customer to ask how they wish to proceed. Return postage costs are the Customer's responsibility, even for orders where shipping was free.
Article 7 – Right of Withdrawal
Consumer Customers have fourteen (14) working days from the date of receipt to withdraw. They must return any unsatisfactory product and request an exchange or refund without penalty, except for return costs, within fourteen days. The Customer bears the return shipping costs in case of withdrawal.
Refunds will be made using the same payment method as the original transaction. The Seller reserves the right to delay the refund until receipt of the Product.
Article 8 – Product Warranty
The legal warranty of conformity applies independently of any commercial warranty. The warranty is limited to 30 days following the date of purchase under normal conditions of use and excludes failures caused by external factors.
In case of non-conformity of a delivered Product, it may be returned to the Seller who will proceed with an exchange. If exchange is impossible (obsolete product, out of stock), the Customer will be refunded. The costs of the exchange or refund procedure for a proven defect are borne by the Seller.
Article 9 – Liability
BELLE BEAUTÉ shall not be held responsible for non-performance of the contract due to a force majeure event. BELLE BEAUTÉ shall not be liable for any indirect damages resulting from the use of the Site.
The choice and purchase of a Product is the Customer's sole responsibility. The total or partial inability to use the Products, notably due to hardware incompatibility, cannot give rise to any compensation, refund or liability of the Seller, except in the case of a proven hidden defect, non-conformity, defect or exercise of the right of withdrawal.
BELLE BEAUTÉ cannot under any circumstances be held responsible for any direct or indirect damage, including loss of profits, loss of earnings, loss of customers or data resulting from the use of the Site.
Article 10 – Force Majeure
In accordance with Article 1218 of the Civil Code, force majeure events are those beyond the control of the parties that they could not reasonably have been expected to foresee. The occurrence of a force majeure event shall automatically suspend the performance of the Order. Beyond a period of ninety (90) days, the Order may be cancelled by either party.
Article 11 – Intellectual Property Rights
All elements of this Site belong to BELLE BEAUTÉ or to an authorised third party. All texts, comments, illustrations and images reproduced on the Site are protected by copyright, trademark law and patent law. Any reproduction or use without prior written authorisation from BELLE BEAUTÉ is prohibited.
The trademarks and logos contained on the Site may be registered by BELLE BEAUTÉ or by one of its partners. Any unauthorised reproduction or use is subject to sanctions under Articles L.713-2 et seq. of the Intellectual Property Code.
Article 12 – Personal Data Processing
The Company collects Customer data for the purpose of processing and tracking orders, contacting Customers about Company-related events, and gathering information to improve the Site. Data is processed by contractual service providers and Shopify Inc. Data is retained only for the time corresponding to the purposes of collection (maximum 5 years).
In accordance with the GDPR, the Customer has the right to access, modify, rectify, delete or oppose the use of their data. The Customer may exercise their rights by email at contact@belle-beaute.com.
Article 13 – Comments and User Submissions
If the Customer sends ideas, proposals or other content to the Company, the Customer grants the Company the right, at any time and without restriction, to edit, copy, publish, distribute, translate and otherwise use such content in any media. The Company is not required to maintain the confidentiality of comments or to pay compensation for any comment provided.
Article 14 – Severability
If any provision of the GTC is found to be illegal or unenforceable, it shall be deemed severable from the GTC and shall not affect the validity of the remaining provisions. These GTC replace all prior written or oral agreements.
Article 15 – Applicable Law and Mediation
These General Terms and Conditions are governed by French law. Disputes may be submitted to mediation at the Customer's request via the European platform: https://consumer-redress.ec.europa.eu
The warranty is limited to 30 days following the date of purchase under normal conditions of use.

Article 16: SMS Policy
By consenting to SMS marketing from BELLE BEAUTÉ at checkout and by initiating a purchase or subscribing via our subscription tools, you agree to receive recurring SMS notifications (for your order, including abandoned payment reminders), SMS marketing offers and transactional SMS messages. Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving SMS marketing messages and notifications, reply STOP to any mobile message sent by us. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider.
